LoveCall Terms of Service

Please read these Terms of Service ("Terms") carefully before using LoveCall (the "Service"). By creating an account and using the Service, you ("Sender," "you") agree to these Terms.

1. The Service

LoveCall lets a Sender schedule a personalized phone call and companion SMS notification to a recipient of their choice — a modern alternative to mailing a physical greeting card. Each call requires the Sender to provide, for that specific call:

• The Sender's name
• The recipient's name
• The recipient's telephone number
• Message content / occasion details

This information must be provided fresh for each call; LoveCall does not save it between calls.

2. Account and Payment

LoveCall is a paid service and requires the Sender to create an account. Payment is processed by our third-party payment processor; LoveCall does not collect or store credit card information.

3. Sender Responsibility for Accuracy

The Sender is solely responsible for providing an accurate and current phone number and accurate recipient details. LoveCall is not responsible for, and will not issue refunds for:

• Calls or messages that fail to reach the recipient due to a rejected call, a disconnected or deleted phone number, or an incorrectly entered phone number
• Any other delivery failure caused by inaccurate information provided by the Sender

4. No Refunds for Circumstances Outside Our Control

LoveCall will not issue refunds for service errors, delays, or failures caused by circumstances outside our reasonable control, including but not limited to carrier network issues, third-party service outages (including voice, SMS, or telephony providers), or other events beyond LoveCall's control.

5. Optional Florist Add-On

If the Sender chooses to add flowers to their call/message via Floristone.com, the Sender's recipient details relevant to that order are shared with Floristone.com solely to fulfill that order. Floristone.com's own terms and policies govern that portion of the transaction.

6. SMS Consent and Opt-In

By using LoveCall to send a call to a recipient, the Sender initiates a one-time SMS notification to that recipient informing them of the incoming personalized call. Every SMS includes an opt-out instruction ("Reply STOP to opt out"). By providing a recipient's phone number, the Sender confirms they have the right to have this one-time notification sent to that number on the recipient's behalf as part of the gift/greeting they are sending.

7. Prohibited Use and Account Suspension

LoveCall is intended for warm, affectionate, celebratory messages — birthdays, anniversaries, and similar occasions. You may not use the Service to:

• Send a breakup, rejection, or relationship-ending message
• Send content that is threatening, harassing, bullying, abusive, or intended to cause emotional distress
• Send a call or message to a recipient who has not consented to receive it, or to a recipient who has opted out (see Section 6)
• Repeatedly call or message the same recipient in a way intended to annoy, alarm, or harass them
• Impersonate another person, or misrepresent your relationship to the recipient, in a way intended to deceive or harm them

LoveCall uses automated content review to detect and block message requests that violate this section, and enforces a limit on how many calls a single recipient number can receive in a given period. These controls are not perfect and do not replace your responsibility to use the Service appropriately.

If we determine, in our reasonable judgment, that a Sender has violated this section, we may suspend or terminate that Sender's account without notice and without a refund for any calls, messages, or credits associated with that account.

8. Data Handling

• LoveCall does not save recipient phone numbers, recipient names, or message content after a call/SMS is delivered — this information must be re-entered for every new call.
• LoveCall does not collect or store payment card information.
• LoveCall does not sell or share personal information with third parties, except as described in Section 5 (Floristone.com, and only when the Sender opts into that add-on).

9. Limitation of Liability

To the maximum extent permitted by law, LoveCall's total liability for any claim arising from use of the Service is limited to the amount paid by the Sender for the specific call giving rise to the claim.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
